Regulatory Support Energy Strategies provides a wide range of regulatory services to all energy sectors. We work in cooperation with client staff, management, legal, & others to represent clients in regulatory proceedings as well as to monitor regulatory trends. We advise clients on commercial impacts likely to result from proposed regulatory actions before state regulatory commissions, in regional venues, and at the FERC. For clients who wish to participate in the regulatory process, Energy Strategies provide expert testimony that can help guide regulator decisions that are just and reasonable. We have provided expert testimony in utility proceedings in 27 states, and testified on behalf of clients served by multiple electric and natural gas utilities. Public Policy Energy Strategies' Public Policy practice area enables clients to navigate the complex world of energy-related issues at the federal, state and local government levels. Our staff brings decades of advocacy experience in the public sector, having served in senior administrative and policy positions in government and the private sector. NATURAL GAS SUPPLY EVALUATION

Natural gas consumers have a supply relationship either with a gas producer, the local distribution company, or with a market services company. While established supplier relationships are typically sound, fundamental questions to evaluate include the cost, value, and reliability of the service compared to evolving market alternatives. Energy Strategies can provide an independent review of a gas consumers current objectives and strategy for managing gas supply, existing service details and risks, and an objective assessment of the alternatives.Energy Strategies has the experience and market knowledge to offer unbiased and independent gas supply source evaluation services. We do not represent any particular supply option, nor do we receive compensation from any counter-party. Our retainer based compensation policy eliminates conflicts of interest.

SUPPLY DEVELOPMENT

The natural gas marketplace offers both supply and price risk, and opportunities to mitigate these risks in the acquisition and management of long term gas supplies. Energy Strategies is adept at refining a Clients need into a supply portfolio that may include long term contracts, annual, seasonal, and monthly purchases, and seasonal storage.LONG TERM GAS SUPPLY OPPORTUNITIESThe acquisition of economical supplies of natural gas includes the development and evaluation of both traditional contract procurement and resource participation alternatives. Long term gas supply alternatives and natural gas resource participation are available in the marketplace. Energy Strategies can identify and evaluate opportunities and risks associated with long term gas supply contracts and reserve or deliverability acquisitions.

Price Risk Management RISK MANAGEMENT INTRODUCTIONEnergy consumers are exposed to a variety of risks resulting from the volatility of natural gas prices in both the physical and financial markets. The need to manage this price volatility has prompted the development of risk management methods and tools designed to reduce the risk of price uncertainty for energy industry participants. Gas price risk mitigation is typically based on a portfolio approach including long term contracts, annual, seasonal, and monthly purchases, storage, and a gas price risk management hedging program. RISK MANAGEMENT SERVICE DESCRIPTIONEnergy Strategies has developed a comprehensive service to help Clients mitigate natural gas price risk. Strict fundamental analysis focuses on weather, storage, transportation infrastructure, and basic supply and demand criteria. Scott Gutting SCOTT GUTTINGPresidentScott Gutting co-founded Energy Strategies in 1986 and leads the efforts of a team of economists, engineers, business strategists and financial analysts in Energy Strategies' diverse consulting activities. Since 1986, Scott has successfully led hundreds of consulting engagements for public and private sector clients including numerous Fortune 100 companies.Scott is on the Board of the Western Electricity Coordinating Council (WECC). Over his 25 year career he and Energy Strategies have supported the development of over 11,000 MW of power generation and transmission assets. Generation technologies include wind, solar, natural gas, hydroelectric, cogeneration, coal, and biomass power projects. Under his direction, the firm is actively engaged in the development of several thousand MWs of electric transmission development.Scott founded, and Energy Strategies manages, the Industrial Gas Resource Corporation (IGRC), a natural gas fuel management corporation for commercial, industrial and power generation consumers, with over 6 Bcf of natural gas per year under management.

Nick Travis ELLIOT R. (NICK) TRAVISPrincipal, Director of Project Development & Investment Services (PDIS)Nick Travis co-founded Energy Strategies in 1987 to extend the range of services then offered to the independent power industry and large natural gas customers by Travis Capital, an NASD member investment banking firm he co-founded in 1985 and managed until 1999. In that year, Nick focused his experience in the energy industry, finance and capital markets on assisting Energy Strategies' clients. Overseeing the firm's PDIS activities, he assists clients to incorporate methodologies, processes and tools to assure decisions regarding client portfolio and individual capital investments are supported by a thorough, effectively communicated understanding of the potential commitments, the nature and quality of resulting benefits, and risks associated with an investment opportunity. Mr. Travis has experience with a wide-range of energy markets and demand management as well as supply technologies. He has worked extensively on projects involving electricity and thermal energy, coal, natural gas, process gas, oil, biomass, LFG, wind, solar, tidal, geothermal, waste-to-energy and small-scale nuclear technologies.

Richard Anderson RICHARD (RICK) ANDERSON, PH.D.Principal, Director Energy Supply & Market Practice AreaRick Anderson joined Energy Strategies in 1994 and has over 30 years of experience in energy-related technical research and policy. His work and practice area management at at the firm encompasses regulatory support, strategic market assessments, and procurement strategy.Rick oversees and provides development of economic assessments of market developments and the likely impact on clients' energy positions. His procurement and market strategy work encompasses all U.S. markets as well as international markets including the U.K., Southwest Asia, and Africa. Rick has also provided expert testimony before various regulatory agencies in multiple states on matters including electric related issues like net power cost, revenue requirement, industry mergers and resource planning. Prior to joining Energy Strategies, Rick was Director of the State of Utah, Division of Energy from 1985 to 1994.

Kevin Higgins KEVIN HIGGINSPrincipal, Director of Regulatory Support Practice AreaKevin Higgins has over 25 years of experience as an economist, management strategist, and public policy specialist. His background includes over 100 appearances as an expert witness in state regulatory commission proceedings on matters involving utility rates and regulatory policy. Since joining Energy Strategies in 1995, Kevin has managed interventions and testified as an expert witness on behalf of industrial and commercial energy consumers in regulatory proceedings before federal regulators and in front of 27 different state commissions. Kevin has been heavily involved in transmission access reform efforts, having participated in the negotiation of the RTO detailed operating procedures incorporated in the WestConnect RTO, served on the Desert STAR Advisory committee, chaired the Arizona Independent Scheduling Administrator (AISA) Operating Committee during the development of the AISA's transmission access protocols.Prior to joining Energy Strategies, from 1991 to 1994, Kevin served as Chief of Staff to the Chairman of the Salt Lake County Commission, the senior appointed position in Utah's largest municipal government. From 1985 to 1991, Mr. Higgins was Assistant Director for resource development for the State of Utah, Division of Energy, where he helped develop and implement state energy policy.

Jeff Burks JEFF BURKSDirector, Sustainability & Climate ChangeJeff Burks joined Energy Strategies in 2008 as Director of the firm's Sustainability and Climate Change practice area, after a 29-year career in the electric utility industry and state government. Jeff is leading the firm's efforts to provide clients with high-level strategic, regulatory, and investment advice, on the many aspects of corporate sustainability, sustainable energy development and climate policy.Jeff recently served as Director of Environmental Sustainability for PNM Resources, Inc., a New Mexico based utility holding company, where he spent four years directing the company's strategic planning, business tactics, policy and program development for its environmental sustainability initiative and climate policy engagements. Jeff represented PNM Resources on the Steering Committee of the U.S. Climate Action Partnership (USCAP) and led the company's participation in the Western Climate Initiative. Prior to joining PNM Resources he spent 25 years working for the state of Utah in various energy policy positions, including State Energy Program Manager, Director of the Utah Office of Energy and Resource Planning, and State Energy Policy Coordinator to Governors Michael O. Leavitt and Olene S. Walker.

Jeff Fishman JEFF J. FISHMANDirector, Gas ServicesJeff Fishman joined Energy Strategies in 2009 as the Director of the Natural Gas Practice Area. With over 30 years of experience in natural gas services and facilities, Jeff's work at Energy Strategies focuses on client natural gas supply, market strategies, and implementation. Jeff currently manages the natural gas supply requirements of a consortium of industrial and municipal gas consumers. He also directs the firm's Gas Price Risk Management Service for industrial, municipal, and utility gas consumers.Prior to joining Energy Strategies, Jeff co-founded and directed Peak Energy, Inc., a consulting firm providing energy market and corporate development activities to a range of energy industry clients. Before establishing Peak, he founded and led the executive management team of Grand Valley Gas Company, an active participant in the creation and development of the deregulated natural gas market in North America. Jeff started his energy career at Northwest Pipeline Corporation, where he directed the development and implementation of an unregulated natural gas gathering and processing business. His natural gas pipeline experience started with a focus on non-traditional gas supply projects management, including the development phases of a $500 million gas treatment facility.

Gary Mirich GARY MIRICHDirector, Energy Supply & Markets Practice AreaGary Mirich joined Energy Strategies in 2001 as a senior consultant. He currently co-leads the Energy Supply and Markets Practice Area. Since joining the firm he has provided consulting services and project management expertise across multiple energy disciplines, including, asset due diligence, price forecasting, investment economics, commodity procurement, contract negotiations, energy risk management, regulatory advocacy, and transmission planning.Gary frequently develops and directs the development of energy price and rate forecasting models for clients who consume and produce energy commodities. He directs the development of market assessments for thermal and renewable energy projects throughout the U.S. Gary's experience in this arena includes quantification of long-term resource needs, in-depth regulatory process investigation, price discovery, available transfer capability, and transmission development by specific project and sub-regional transmission area. He also represents business class energy consumers in proceedings before state regulators and has supported client filings at the FERC. Prior to joining the firm, Gary held various positions on staff and management at Arizona Public Service Company and Enron Energy Services. His energy industry experience began with IBM as a client executive for the electric utility industry.

Don Hendrickson DON HENDRICKSONSenior ConsultantDon Hendrickson joined Energy Strategies in 2005. His work primarily involves project and facilities modeling for investment analysis and decision support. He also works with natural gas and electricity supply risk analysis, employing Monte Carlo and other simulation disciplines. Don is a staff member of the Industrial Gas Resource Corporation (IGRC), a gas-buying member organization managed by the firm. In this capacity, he is involved in commodity procurement, nominations and balancing, price hedging, and regional pipeline market dynamics.Prior to joining Energy Strategies, Don worked as a process analyst at Flying J, within the Supply and Distribution division. There he worked on supply optimization projects, ethanol plant feasibility, business development, and customer risk management concepts. From 1996 to 2003, Mr. Hendrickson worked for Duke Energy Trading and Marketing in its Salt Lake City location as a Director of Power Trading. He was responsible for physical, financial and option trading in the western region. He also took part in deal valuation and market pricing. Prior to his trading position, he worked in modeling and analysis dealing with generation assets, power and gas RFPs, and WSCC electricity supply and demand balance.

Neal Townsend NEAL TOWNSENDSenior ConsultantNeal Townsend joined Energy Strategies in 2001 and supports the firm's consulting efforts on both regulatory matters and client strategic market assessments. In this capacity, he provides technical assessments of various energy issues, and develops and reviews computer models used to evaluate electric and natural gas matters on behalf of Energy Strategies' clients. His regulatory expertise includes investigation of inter-state cost allocation across multiple jurisdictional entities served by a single electric utility, cost allocation across various customer classes of electric and natural gas utilities, modeling used to estimate and simulate an electric utility's variable power costs, development of avoided and marginal cost studies, and electric utility resource planning. Prior to joining Energy Strategies, Neal was a Utility Rate Analyst with the State of Utah, Division of Public Utilities where he performed numerous analyses and investigations of electricity and natural gas issues requiring regulatory oversight. Neal also worked for a consulting petroleum engineering firm that provided economic and technical assessments of producing oil & gas wells and drilling prospects.

Rob McKenna ROBERT (ROB) McKENNASenior ConsultantRob McKenna re-joined Energy Strategies in 2007 and has dedicated the majority of his time serving clients focused on Strategic Integrated Energy Planning and the development of clean, renewable energy alternatives throughout the United States. The Strategic Integrated Energy Planning efforts have been focused on assisting organizations to reduce their overall environmental impact and increase the operational and economic efficiencies of their operations while enhancing the coordination of the facilities mission with the overall institutional mission and vision. Rob has also supported a multi-billion dollar international mining company by identifying blue-chip solar developers to develop a utility scale concentrating solar power facility at a reclaimed mine site in the desert Southwest. Prior to joining Energy Strategies, Mr. McKenna fulfilled a variety of management, product development and commercialization roles in multiple Fortune 500 companies focused on technology development and commercialization. He has spent a significant amount of time facilitating group collaboration and idea generation enhanced by advanced methods that streamline the option development and decision making process. Mr. McKenna has a keen interest in the practical application of technology in ways that enhance lives and improve the globe. Mr. McKenna holds 10 U.S. Patents and Patents Pending.

Kelly Francone KELLY FRANCONEConsultantKelly Francone joined Energy Strategies in March 2005. Her work involves coordination of legislative and regulatory support for Utah's largest consortium of industrial energy consumers, the Utah Association of Energy Users (UAE). This work entails researching, analyzing and assessing the technical and financial aspects of various energy issues, as well as determining the impact of regulatory actions on customer rates. Kelly also manages the UAE web site and creates/publishes a weekly energy brief and monthly newsletter to keep clients abreast of energy-related news at both state and federal levels. She also directs one of the largest annual energy conferences in the Western U.S., which brings together representatives from large industrial corporations, state regulation, the legislature, utilities, and other energy-related businesses.Kelly also performs specific research and analysis for senior staff members on both regulated and unregulated energy issues. She researches activities at the Western Electricity Coordination Council (WECC) as they relate to large energy users, energy producers and regulation in Utah. She also tracks state and federal legislation to interact on behalf of industrial clients, as well as determining what impact such actions will have on energy rates.

Oliwia Smith OLIWIA SMITHConsultantOliwia Smith joined Energy Strategies in 2008. Her project engagements focus primarily on supporting the firm's regulatory practice area. Her responsibilities involve assisting the firm in evaluating utility rate filings on behalf of clients, and providing analytical support on a variety of regulatory matters. To that end, she builds and maintains various rate models and communicates the results of her quantitative and qualitative analysis to senior staff members. Oliwia began her career in the utility regulatory field in 2001 at the Utah Department of Commerce. There, she remained on the staff of the Committee of Consumer Services as a Utility Analyst until 2005. In that capacity, Oliwia was responsible for conducting economic analysis and providing policy recommendations on multiple matters pertaining to rate regulation. She provided expert witness testimony before the Utah Commission as well as the Utah Legislature, and was instrumental in crafting provisions to a major telecommunications bill passed during the 2005 Legislative Session. This effort secured regulatory oversight for services with few competitive alternatives, yet it allowed the utility to flexibly price products for which a competitive market developed. Ms. Smith was subsequently invited to present the results of this legislative effort to the members of the Wyoming State Legislature.

Justin Farr JUSTIN FARRConsultant Justin Farr joined Energy Strategies in 2005 and has been involved in engagements spanning the firm's practice areas. His work focuses on providing research, modeling, and quantitative analysis. He has contributed to contract negotiations, utility valuations, regulatory filings and rate analysis, and facilities planning projects requiring decision and risk analysis. Justin's recent work on Climate Action Plans has involved projecting and analyzing the impacts of future carbon legislation on business entities and universities, and developing strategies to mitigate the risks and costs associated with such legislation. Justin has been directly involved in state-wide public policy efforts to increase energy efficiency and reduce greenhouse gas emissions. He participated as a member of the Work Group that supported the Utah Governors Blue Ribbon Advisory Council on Climate Change (BRAC), and served as a co-chair of the Residential, Commercial, and Industrial sub-working group. Prior to Energy Strategies, Justin worked in the Utah Governor's Office of Planning and Budget (GOPB) where he served as a Research Analyst/Economist in the Demographic and Economic Analysis division.

Caitlin Liotiris CAITLIN LIOTIRISConsultantCaitlin Liotiris joined Energy Strategies in 2006. Her primary work efforts include market and regulatory evaluations, building economic models, performing economic analysis and conducting research. She has consulted for clients on a variety of energy procurement, energy efficiency, regulatory, and transmission projects. Caitlin assists senior staff in economic and financial analysis of power supply options for the high voltage transmission projects in the West. Her work has included evaluating the costs of possible generation options, assessing power needs and power supply options in the West and performing background research. She closely follows the renewable procurement activities of utilities in the West and assesses their need for additional renewable energy. . Caitlin represents large industrial energy users in both state and regional greenhouse gas forums. Beginning in 2007, she has acted as a representative for large energy users in such forums as the Western Climate Initiative, a regional effort to reduce greenhouse gas emissions. In addition, she is currently working with a large group of power marketers and generators to represent their interests, and keep them apprised of important activities at the Western Electricity Coordinating Council (WECC). Mrs. Liotiris is also working with a group of entities which support the development of an Energy Imbalance Market in the West.

Courtney Higgins COURTNEY HIGGINSAnalystCourtney Higgins joined Energy Strategies in 2011. Her primary roles involve multiple areas of responsibility within the firm's regulatory services practice area. She works closely with senior staff and other analysts at the firm conducting research, supporting development of expert witness testimony, compiling reports and data, and assisting with market and regulatory analyses. Courtney is also responsible for daily and monthly reports to the firm's large natural gas-using clients that consist primarily of large industrial and public sector entities. These reports contain detailed market information and insight on both electricity and natural gas prices and support Energy Strategies' clients with their purchasing and hedging decisions.
